The Nigerian Bar Association (NBA) has refuted allegations suggesting that the Samoa Agreement, recently signed by the Federal Government, imposes obligations on Nigeria to endorse or accept LGBTQ rights.
In a statement issued by NBA President Yakubu Maikyau, it was clarified that the agreement does not compromise Nigeria’s sovereignty or its existing laws, including the Same Sex Marriage (Prohibition) Act of 2023.
Maikyau emphasized that had the agreement conflicted with Nigerian laws, particularly regarding LGBTQ rights, the NBA would have advised against its signing by the government.
He further urged for continued public awareness efforts regarding the Samoa Agreement, stressing the importance for stakeholders to educate the public accurately on its provisions.
The statement affirmed: “The Samoa Agreement does not contain any provisions requiring Nigeria to recognize LGBTQ rights as a precondition for a $150 billion USD loan or otherwise. The agreement explicitly respects local laws and the sovereignty of participating nations. This includes Nigeria’s Same Sex Marriage (Prohibition) Act of 2023 and the supremacy of the 1999 Constitution of the Federal Republic of Nigeria, as amended.
“If the Samoa Agreement had posed a threat to our nation’s sovereignty or laws, the NBA would have advised the Federal Government against entering into such a partnership.
“For clarification, the Samoa Agreement does not seek to compromise our existing legislation or undermine Nigeria’s sovereignty.
“It is imperative that stakeholders who have engaged with the Government on this agreement and those who understand its objectives educate the public on its true contents.
“The negative perceptions surrounding this agreement are based on sensitive aspects of our faith, culture, and morality. Therefore, caution and proper education are crucial.
“I urge the Government to continue its ongoing efforts in public enlightenment and call on all stakeholders to join in disseminating accurate information to counter the negative narratives circulating about the agreement.”
